1. Who we are
1.1 The service "HexAlpha Academy" ("the Academy", "we", "us", "our") is provided by HEXENKRAFT s.r.o., V zahradách 2462/31, Libeň, 180 00 Praha 8, Czech Republic, IČO 29665931, DIČ CZ29665931, registered in the Commercial Register kept by the Municipal Court in Prague, section C, file 450419. Contact: matic@hexenkraft.cz.
1.2 HexAlpha Academy is an educational publisher, not an investment adviser, broker, or dealer, and it is not authorised or regulated as such. See section 3.
2. What these Terms cover; acceptance
2.1 These Terms govern your access to and use of the Academy: the website, the free Level 1 content, paid Level 2 and Level 3 content where offered, quizzes and exams, certificates, the read-only HexAlpha learning sandbox, and any email we send you.
2.2 By creating an account, accessing content, or completing a purchase you accept these Terms, the Privacy notice, and the disclosures set out below. If you do not accept them, do not use the Academy.
2.3 You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to use the Academy.
2.4 Governing law. These Terms are governed by the law of the Czech Republic. If you are a consumer, you also keep the protection of the mandatory consumer-protection rules of the country where you habitually live, and nothing in these Terms takes that protection away.
3. What we provide: education, not advice
3.1 Everything the Academy provides is general educational information about how options and related derivatives work. It is impersonal and is not tailored to any individual's objectives, financial situation, jurisdiction, eligibility, or needs.
HexAlpha Academy is an educational publisher. We are not an investment adviser, broker, or dealer, and using this course does not create an advisory or fiduciary relationship. We do not know your circumstances and cannot tell you what is right for you. Any examples, tickers, chains, or strategies shown are for illustration of how things work, never instructions to act.
We do not advertise trading returns, win-rates, or income. We make no promise or implication that you will earn money, avoid losses, or achieve any particular result. Most retail traders who use leveraged or derivative products lose money. Any figures shown anywhere in this course are illustrative of mechanics, not of results you can expect.
3.2 Nothing in the Academy is a financial promotion, inducement, or solicitation to buy, sell, or hold any security, derivative, or strategy.
4. Risk warning
Options and other derivatives are complex, high-risk instruments. You can lose money rapidly, and in some strategies you can lose more than you invest. Options are not suitable for everyone. HexAlpha Academy provides general educational information only, it is not financial, investment, legal, or tax advice, and it does not take account of your personal objectives, financial situation, or needs. Nothing here is a recommendation to buy, sell, or hold any security, derivative, or strategy. Before trading, consider whether you understand how these products work and whether you can afford to take the high risk of losing your money. If in doubt, seek advice from an independent, appropriately authorised professional. Past performance is not a reliable indicator of future results.
5. Eligibility and jurisdiction
This course is general information and is not directed at any person in any jurisdiction where options trading, this content, or its availability would be unlawful. Options and the strategies discussed are not available, permitted, or suitable in every country, and eligibility requirements (such as broker approval levels) apply. You are responsible for complying with the laws and rules that apply to you.
6. Accounts
6.1 You are responsible for the accuracy of your registration data, for keeping your credentials secure, and for activity under your account.
6.2 We may suspend or terminate an account for breach of these Terms, fraud, abuse, chargeback abuse, or unlawful use. If we close an account that holds paid content for any reason other than your breach, we refund the unused part.
7. Pricing, VAT and payment
7.1 Level 1 is free. Levels 2 and 3 are paid where offered: one global price in EUR, the same in every country, taxes included. At the date of these Terms the paid levels are not yet on sale; the website offers a waitlist only.
7.2 The price you see is the price you pay. Where VAT applies it is already inside that price and we account for it in the consumer's country.
7.3 Payment is taken by our checkout provider, which may act as merchant of record. If it does, that provider is your contracting party for the purchase and handles VAT, invoicing and the withdrawal right, and we name it at checkout. Card data is handled by that provider, not by us.
8. Digital content, immediate access and the right of withdrawal
8.1 The paid levels are digital content not supplied on a tangible medium. With your consent under section 8.3 we deliver them for immediate use on purchase.
8.2 Statutory right of withdrawal. Under EU and Czech consumer law a consumer ordinarily has a 14-day right to withdraw from a distance contract.
8.3 Express waiver for immediate access. Because the digital content is delivered immediately, the right of withdrawal is lost if, before delivery begins, you give express prior consent to immediate access and acknowledge that you thereby lose the 14-day right of withdrawal. When paid levels open, we will ask for this consent at checkout through a separate, un-ticked checkbox, keep a timestamped record of it, and confirm it to you by email.
8.4 If you do not give that consent, access starts after the 14-day period has passed, and you may withdraw within that period by emailing matic@hexenkraft.cz. A clear statement is enough, for example: "I withdraw from my purchase of Level 2 made on [date], username [username]." We confirm receipt by email and refund within 14 days.
8.5 Any goodwill refund we choose to offer is stated separately and does not limit your statutory rights, including your rights if digital content is defective or does not conform to the contract.
9. The HexAlpha learning sandbox
9.1 Lessons show HexAlpha, a research and analytics tool owned by HEXENKRAFT s.r.o., as a frozen-data, read-only practice surface: no order entry, no execution, no signals to act on. We do not sell access to HexAlpha through the Academy.
HexAlpha is a tool built and owned by HEXENKRAFT s.r.o., the same company behind HexAlpha Academy. We have a commercial interest in you using it. Inside this course, HexAlpha is a read-only practice surface for observing and learning to read the market, it is not a signal service, and nothing it displays is a recommendation or advice.
9.2 Before any purchase completes you must acknowledge the risk warning (section 4) and the data notice (section 12), and, for immediate access, give the consent in section 8.3.
10. Certificates
10.1 Passing a level's assessment at the required standard (85 percent, unlimited retakes, fresh form each time) issues a completion certificate, for example Foundations.
This certificate recognises completion of educational coursework with HexAlpha Academy. It is not a professional license, regulatory qualification, or authorisation to trade, advise, or manage money for others, and it does not signify any particular skill level guaranteed to produce trading results.
11. How we make money; the broker referral disclosure
Level 1 is free. Levels 2 and 3 are paid, one global price, the same in every country, taxes included. HexAlpha, our own research tool, appears in lessons as a frozen-data practice surface only; we do not sell access to it. We also earn a referral fee if you open an Interactive Brokers account through our link. We recommend IBKR because it's the platform our founder actually trades on and one of the few brokers offering options to retail traders in most countries, and we earn a fee, which we're telling you so you can weigh it yourself. Other brokers exist. Do your own research, we teach process, not promises.

11.1 We use the Interactive Brokers commercial affiliate programme. Opening a broker account and any trading you do is a contract between you and the broker, not with us.
12. Data protection
12.1 We process personal data under the GDPR (Regulation (EU) 2016/679) and Czech data-protection law, as described in the Privacy notice.
We collect and process your personal data, including account details and course progress, to provide the Academy, under a lawful basis described in our Privacy Notice. Marketing emails are sent only with your consent, which you can withdraw at any time via the unsubscribe link or by emailing matic@hexenkraft.cz. You have rights to access, correct, and delete your data.
13. Intellectual property
13.1 All course content, scripts, video, audio, assessments, item banks, job aids, and the HexAlpha software are owned by HEXENKRAFT s.r.o. or its licensors. You receive a personal, non-transferable, non-sublicensable licence to access the content you have lawfully obtained, for your own learning. No copying, redistribution, scraping for resale, or public performance. Private-use exceptions that the law grants you are not affected.
14. Disclaimers and liability
14.1 The Academy is provided for education. To the extent the law permits, we give no warranty beyond the statutory conformity of the digital content. Statutory consumer rights, including your right to damages, are not excluded or limited.
14.2 We are not responsible for your trading decisions, your broker, third-party platforms, or market outcomes.
15. Changes to these Terms
15.1 We may update these Terms. Material changes are announced on this page and by email to account holders at least 14 days before they take effect. If you do not accept a change, you may close your account before that date; changes never apply retroactively to a completed purchase.
15.2 The disclosure wording in force is the version published at hexalpha.eu/legal/terms/ at the time of your purchase.
16. Complaints and dispute resolution
16.1 Contact matic@hexenkraft.cz first; we answer within 14 days.
16.2 Any consumer may take an unresolved dispute with us to the Czech Trade Inspection Authority (Česká obchodní inspekce), the out-of-court dispute body for consumer contracts with a Czech trader: adr.coi.cz, Štěpánská 796/44, 110 00 Praha 1.
